This handbook is published by the Australian Electoral Commission (AEC), the independent agency responsible for maintaining the electoral roll and conducting federal elections, by-elections, and referendums.
It provides an overview of the electoral process relevant to candidates, with each section outlining key aspects of the Commonwealth Electoral Act 1918 (the Electoral Act) and how the law applies to candidates and their campaign teams. While this handbook is a useful guide, it is not a substitute for the law. Candidates should refer directly to the Electoral Act, the Commonwealth of Australia Constitution Act (the Constitution), and other relevant legislation, such as the Referendum (Machinery Provisions) Act 1984, to fully understand their legal responsibilities.
The AEC provides general information on the nomination process and campaign activity but does not offer legal advice. Candidates are responsible for ensuring they comply with all legal requirements.
